Representative Matters

  • Obtained a defense verdict from a federal jury on behalf of a products manufacturer sued by a property owner for breach of warranty and misrepresentation claims arising from the installation of the client’s product in a commercial building.
  • Litigated a shareholder dispute over the breach of a purchase and sale agreement with respect to shares in a close corporation; the litigation resulted in a favorable jury verdict for the client.
  • Defended a company against a breach of contract and related employment claims through litigation and bench trial; the trial concluded in a judgment in favor of the client.
  • Secured a dismissal of a breach of contract and business tort claims on behalf of a lender client.
  • Represented shareholders in connection with breach of contract and business tort claims arising out of an acquisition dispute.
  • Represented a restaurant chain in a lease-based dispute with a commercial landlord involving a claim for lost profits.
  • Successfully negotiated a resolution of employment-based claims brought by the director of a not-for-profit client.
  • Represented a lender in connection with responding to a third-party subpoena, successfully negotiating a revised scope of subpoena, thereby minimizing cost and burden upon the client.

Hillary Lehmann is of counsel in Lubin Olson’s Litigation, Commercial Litigation, and Real Estate Litigation service groups. Ms. Lehmann focuses her practice on the defense and prosecution of complex commercial disputes involving contract claims and business torts in a variety of commercial settings, with a focus on real estate litigation and general business litigation. Ms. Lehmann’s real estate litigation experience includes real estate investment fraud, commercial lease disputes, claims against real estate brokers and for non-disclosure in the purchase and sale of real estate, and claims by and against mortgage brokers and private lenders. Ms. Lehmann’s general business litigation experience includes merger and acquisition disputes, contract claims concerning payment and indemnification obligations, and construction disputes.

Ms. Lehmann’s litigation experience includes trying cases in state and federal courts, taking and defending depositions, and preparing and arguing motions. Among her accomplishments, she has won cases on behalf of her clients in both bench and jury trials in federal and state courts, obtained orders dismissing cases brought against her clients, and negotiated favorable settlements in a variety of cases. 

Additionally, Ms. Lehmann has been selected by Thomson Reuters as a Super Lawyer “Rising Star” from 2016 to 2022.

Prior to joining Lubin Olson, Ms. Lehmann practiced litigation at Troutman Pepper Hamilton Sanders (in San Francisco), Smith, Currie & Hancock LLP (in San Francisco), and Todd & Weld LLP (in Boston).
