Advising Clients in the Development and Financing of Affordable Housing Projects

Lubin Olson represents owners and developers in the acquisition, entitlement, rehabilitation, financing, development, and operation of affordable housing projects. 

We collaborate with our clients and advise our clients regularly on ground leases, loan documents, bond documents, partnership agreements, regulatory agreements, due diligence materials, architect and construction agreements, title policies and surveys, covenants and restrictions, easements, and licenses. Affordable housing projects tend to involve multiple layers of financing and a combination of construction debt, permanent debt, tax-credit equity, and subordinate debt from various public agencies. To ensure a successful transaction, we work hand-in-hand with our clients to review, negotiate, and analyze the issues relevant to their roles in the housing process.

We work closely with attorneys and program staff at numerous public agencies, including the Department of Housing and Urban Development (HUD), the California Housing Finance Agency, the California Tax Credit Allocation Committee, and the California Department of Housing and Community Development, as well as local entities, such as the Housing Authority of the City and County of San Francisco and the San Francisco’s Mayor’s Office of Housing and Community Development, among others. We have handled affordable housing transactions in California, Arizona, New Mexico, and Hawaii. We are also experienced in guiding our clients in navigating the intricacies of HUD financing programs, including programs like HOME, HOPE VI, Section 8 certificates and vouchers, FHA Insurance, Section 223(a)(7), Section 236, Section 202, and Rental Assistance Demonstration (RAD).
