  • Bay Area SMACNA Project Management Certificate Program (2023 – 2025) – Presented an overview of legal issues affecting construction projects, with a focus on California law, to members of the Bay Area Chapter of the Sheet Metal and Air Conditioning Contractors’ National Association.

Representative Matters

  • Secured a full arbitration award for a general contractor in a breach of contract dispute arising from a subcontractor’s abandonment of multiple projects.
  • Represented an international distributor of multi-platform MLPE solutions in a product defect action arising from an allegedly underperforming photovoltaic system installed at a transitional care facility. Secured a complete release and dismissal with prejudice on exceptionally favorable terms for the client immediately before opening statements at trial.
  • Represented an individual in a partnership dispute involving breach of fiduciary duty claims and an attempt to enforce a non-compete clause to prevent the client from starting his own business. Negotiated a favorable settlement.
  • Represented an international distributor of multi-platform MLPE solutions in a high-stakes product defect dispute involving an allegedly underperforming photovoltaic system installed at a golf and country club. Secured a complete dismissal with prejudice and full release of all claims on exceptionally favorable terms for the client immediately before the commencement of trial.
  • Obtained temporary restraining orders and preliminary injunctions prohibiting the use of contractor-client’s trade secrets by former employees’ competing business.
  • Obtained an emergency temporary restraining order delaying the destruction of an untapped artesian well beneath homeowner-clients’ condominium during a case management conference where inadequate notice of the planned destruction left clients without the opportunity to appear and seek a restraining order under conventional procedures.
  • Successfully defended against a petition to release a mechanic’s lien, preserving a contractor-client’s lien rights and ensuring the lien remained in place pending resolution of litigation with the owner.

Craig A. Kisylia is an attorney in Lubin Olson & Niewiadomski LLP’s Construction Law, Commercial Litigation, and Real Estate Litigation practices. Mr. Kisylia’s practice focuses primarily on construction and commercial matters. He handles disputes and transactional matters for a wide range of clients, including owners, contractors, subcontractors, and suppliers throughout all phases of construction as well as litigation in both state and federal court and arbitration.

Mr. Kisylia has experience successfully representing clients facing a number of construction-related issues, such as construction defects, differing site conditions, delays, termination, extra work, warranties, and payment and retention withholdings as well as the negotiation and drafting of construction contracts. He also has experience successfully litigating commercial disputes involving misappropriation of trade secrets, partnership and corporate agreements, and fiduciary duties.

Mr. Kisylia has been honored by Thomson Reuters as a Northern California Super Lawyer® “Rising Star” for 2022 – 2025.

Prior to joining Lubin Olson, Mr. Kisylia practiced business and construction law at Burke, Williams & Sorenson, LLP in Oakland, California.
